Fees

Rules establish how couples conduct themselves during Divorce
Mediation. Although different court programs have different
guidelines, the following is a sample of common guidelines used in
Divorce Mediation in Atlanta, Georgia.
1. Leave fault and blame aside. Pointing the finger at
your spouse does not help negotiations in Divorce
Mediation.
2. Accept responsibility for yourself. Each spouse
needs to speak up for themselves throughout the
Divorce Mediation.
3. The Mediator does not make decisions for the
parties. The Mediator will lead negotiations and
assist the parties in reaching a decision which is
acceptable to both. The outcome of Divorce
Mediation is controlled by the parties.
4. The Mediator is not acting in the capacity of an
attorney and does not offer legal, financial or tax
advice. Both spouses are encouraged to have an
independent divorce attorney look over any
completed Divorce Mediation Agreement. Each
spouse has the right to have their own divorce
attorney present during the Divorce Mediation. A
Divorce Mediation Agreement will incorporate all
issues agreed upon. Both spouses should have
their own divorce lawyer look over any finalized
Divorce Mediation Agreement prior to signing any
papers. Both spouses are also responsible for
having their own accountant or tax advisor look over
the agreement to make recommendations about tax
consequences.
5. The Mediator will keep information gathered in
Divorce Mediation confidential and private, with the
exception of statements about child abuse or threats
of violence. The Mediator will not testify for or against
either spouse. Both spouses agree not to subpoena
the Mediator to testify concerning the Divorce
Mediation in any subsequent court actions.
6. At times during the Divorce Mediation, the Mediator
may meet individually with each spouse. This is
called a caucus. Either spouse or the Mediator may
request a caucus. The Mediator will not share
information learned during a Divorce Mediation
caucus with the other spouse unless given
permission to do so.
7. If divorce lawyers are not present at the time of
Divorce Mediation, the spouses shall have ten days
from signing any Divorce Mediation Agreement to
have their attorneys and other advisors review the
Divorce Mediation Agreement before it becomes
binding.
